AS-IS NO WARRANTY
To the best of our knowledge the manufacturer's warranty has expired on pre-owned vehicles. Consult the manufacturer's warranty booklet for details as to warranty coverage, service location, etc., for new vehicles as well as pre-owned vehicles where the balance of the Manufacturer's warranty has not yet expired. Gerton Auto Sales, Inc. sells all vehicles AS-IS WHERE-IS and assumes no responsibility for any repairs. All warranty coverage, if any, comes from the unexpired manufacturer's warranty.
The seller shall not be responsible for the correct description, authenticity, genuineness, or defects herein, and makes no warranty in connection therewith. No allowance or set aside will be made on account of any incorrectness, imperfection, defect or damage. Any representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the buyer to have thoroughly inspected the vehicle/item, and to have satisfied himself or herself as to the condition and value and to buy based upon that judgment solely. ALL vehicles/items will be available for inspection at our dealership, unless otherwise noted. Seller assumes no responsibility for any repairs regardless of any oral statements about the vehicle/item. LEGAL
This agreement shall be governed by the laws of the State of Indiana. By buying, you hereby consent to the exclusive jurisdiction and venue of courts in Posey County, Indiana in all disputes arising out of or relating to any aspect of any transaction involving the item offered. Selling of this item is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, specifically including this paragraph. The offering for sale of this item by Gerton Auto Sales, Inc. is subject to existing laws and legal process and nothing contained in this agreement is in derogation of its right to comply with governmental, court and law enforcement requests or requirements relating to your participation in this sale/auction or information provided to or gathered with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
DEPOSITS
Effective 1/1/2024 deposits to secure a unit and take it off the market will be as follows:
Any IN-STOCK motor vehicle (not RV) $500.00
Any IN-STOCK RVs - Trailers $1000.00 Motorhomes $1500.00
Any INBOUND available RV - Trailers $1000.00 Motorhomes $1500.00
Any SPECIAL-ORDERED RV - $2500.00
The full amount of the deposit goes toward your purchase. These deposits are NON-REFUNDABLE.
FEES and SALES TAX
We charge a $225.00 documentation fee. This fee will be higher for International buyers due to wire transfer fees and international mailing costs which can vary by purchase price and buyer's location, please contact the dealership for details.
The state of Indiana requires us to collect sales tax, based upon the buyer's home state rate (if any), on all vehicles* sold and delivered in the state of Indiana, regardless of buyer's state of residence and includes instances where an out-of state buyer arranges for their purchase to be transported outside of the state of Indiana. Your state should allow a sales tax credit for sales tax paid to Indiana against your state's sales tax (if any). IT IS YOUR RESPONSIBILITY TO CONTACT YOUR STATE'S TAX AUTHORITIES CONCERNING YOUR ENTITLEMENT TO SALES TAX CREDIT. Exceptions: 1) Registered motor vehicle dealers buying for resale (dealer documentation required), 2) Transportation out of the State of Indiana is arranged by Gerton Auto Sales, Inc., at the expense of the buyer, and listed on the Retail Purchase Agreement. Gerton Auto Sales, Inc. will choose the carrier based upon our experience with certain transport companies. Buyer may choose whether the vehicle is shipped open or enclosed.
* RVs are taxed differently than vehicles, please contact the dealership for information. All parts, accessories, or other items purchased at our store will be subject to normal Indiana sales tax (currently 7%).
Sales tax statutes can change, therefore all purchases will be governed by the Indiana sales tax statutes in effect at the time of purchase.
FINANCIAL
Most banks and credit unions do not finance vehicles older than 1995 or with more than 100K miles. Make sure, if financing, that your financial institution accepts the year and miles of this vehicle before agreeing to purchase. We also accept VERIFIABLE Cashier's or Certified Checks from U.S. banks, VERIFIABLE loan checks, cash (in person), and wire transfers. If you elect to pay by bank wire, a wire transfer fee will be added to the purchase price. Purchase MUST be paid for in full and funds verified before delivery or release to transport companies. Gerton Auto Sales, Inc. must comply with the USA Patriot Act and IRS cash reporting guidelines as well as other federal and state regulations, therefore you will be required to provide your Social Security Number and Driver's License. Vehicles will be titled to the buyer and title will be sent to the buyer when funds have cleared our bank. All vehicles with a 17-digit VIN (1981 and up)will come with a vehicle history report, unless otherwise noted (customized vehicles/show vehicles, RV's, Off-Road vehicles, etc.), and will be available upon request prior to purchase.
SHIPPING
Buyer is responsible for pickup or shipping of this vehicle. If you wish to have it shipped using a service, we will gladly cooperate. You can locate your own shippers by doing a search for "auto shippers", or we can arrange transportation for you (please see "Fees and SalesTax" section above). If you wish to fly in and drive home, we will be happy to pick you up at Evansville Regional Airport, but please make arrangements with us in advance. All shipping costs are the responsibility of the buyer.
INFORMATION
The seller shall and will make every reasonable effort to disclose any known defects associated with this vehicle/item, at the buyer's request, prior to the close of sale. Common sense dictates that, since these vehicles/items are not new (unless otherwise stated), normal wear and tear from use and aging is to be expected and will not be considered grounds for refusal to complete a purchase.
If you are not sure about something, please ask! Do not assume anything not listed is included. All vehicles will come with one master key. Please see listing or call concerning extra keys, remotes, and books/manuals. We reserve the right to end the listing if the vehicle is no longer available for sale.
